Ireland’s Competition and Consumer Protection Commission (CCPC) has executed unannounced searches of businesses operating in the solar panel industry as part of an active investigation into alleged anti-competitive behavior.
The operation, carried out by Authorized Officers from the CCPC with assistance from An Garda Síochána’s District Detective Units and local police, targets suspected breaches of competition law centered around potential bid-rigging schemes. Armed with search warrants issued by the District Court, officials inspected business premises to seize information and evidence related to the investigation.
Bid-rigging—a severe form of illegal cartel conduct—occurs when competing firms secretly collude on tender processes rather than competing independently. Anti-competitive practices in tenders typically include predetermining contract winners, submitting false cover bids, rotating winning bids, or agreeing to abstain from bidding altogether.
CCPC Commission Member Úna Butler emphasized that while unannounced searches do not inherently confirm that a breach of competition law occurred, robust enforcement remains vital for the Irish economy. Fair competition drives innovation, supports sustainable economic growth, and ensures public bodies and private consumers secure optimal value for money.
To aid the ongoing probe, the watchdog is appealing to individuals and industry insiders with relevant information to come forward. The CCPC highlights several avenues for cooperation, including its anonymous online reporting portal, as well as its Cartel Immunity and Administrative Leniency programs run alongside the Director of Public Prosecutions. Individuals involved in unlawful cartel behavior may secure immunity or reduced penalties by disclosing their participation and fully cooperating with investigators.
