The Netherlands Authority for Consumers and Markets (ACM) has imposed a 270,000 euro fine on House of Tickets BV, the operator of the auction website Ticketveiling.nl, for systematically misleading consumers through automated price gouging. A regulatory investigation revealed that between August 1, 2024, and December 1, 2024, the company deployed a specially designed algorithm to participate in its own auctions. Users bidding on various outings, services, and products were under the impression they were competing against other real people. In reality, they were bidding against an automated bot that used artificial names and varying bidding strategies to unlawfully drive up final prices.
This deceptive practice affected over 70,000 auctioned lots during the four-month period. The algorithm was primarily used to guarantee a secret minimum price for the items on offer. If the bot outbid the human participants and won the auction, the company would then present the winning amount to the highest human bidder as an offer. Consumers accepted these offers without ever being informed that their primary competitor was a computer program controlled by the platform itself. The ACM determined that this manipulation deliberately prioritized commercial interests over consumer transparency, trapping thousands of buyers into accepting inflated prices they might have otherwise rejected.
House of Tickets BV has acknowledged the violations, accepted the penalty, and waived its right to object or appeal the decision. Prior to the ACM investigation, the company had already halted its auction operations. Because of its cooperation through a simplified settlement process, the company received a 10% reduction on the initial penalty, resulting in the final 270,000 euro fine. ACM board member Martijn Ridderbos emphasized that fair auctions rely entirely on genuine supply and demand, noting that such deceptive algorithms severely damage public trust in digital marketplaces. The regulator has stated it will maintain strict oversight on the use of algorithms to ensure fair competition moving forward.
