Antitrust Review Targets Mexico’s Rail Freight Sector

Mexico’s National Antimonopoly Commission has initiated formal proceedings to assess the existence of potential barriers to competition in several relevant markets related to public rail freight transport services.

According to a statement issued on February 5, 2026, the Commission’s Investigative Authority has concluded the investigative phase concerning alleged barriers to competition in the national rail freight transport sector. The investigation examined market conditions affecting the provision of public freight rail services across Mexico.

Following the publication of the preliminary findings, interested economic agents will be entitled to submit arguments, evidence, and observations. The Plenary of Commissioners will subsequently review the full evidentiary record before issuing a final resolution aimed at ensuring improved competitive conditions in the sector.

Public rail freight transport plays a critical role in Mexico’s production and supply chains, facilitating the long-distance movement of large volumes of goods, including food products, fuels, construction materials, vehicles, and consumer goods. The efficiency of this service directly affects production costs and, ultimately, the prices paid by Mexican households.

The National Antimonopoly Commission stated that it will formally address the outcome of the proceedings once all stages of due process have been completed and a final decision has been adopted by the Plenary.
