The Public Agency of the Republic of Slovenia for the Protection of Competition (the Agency) has announced that it will conduct a comprehensive survey of the television advertising market in Slovenia. The decision, adopted on 20 June 2025, is based on Articles 12, 28, and 51 of the Act on the Prevention of Restrictions of Competition (ZPOmK-2).
Under ZPOmK-2, the Agency is empowered to investigate specific sectors or types of agreements whenever price rigidity or other circumstances suggest the likelihood of restrictions or distortions of competition within Slovenia. Following its own monitoring activities and based on information obtained from market stakeholders, the Agency identified structural features in the television advertising sector that warrant closer examination.
This is not the first time the Agency has scrutinized the sector. The market was previously assessed in Decision No. 306-90/2009-169 of 24 April 2013. Given the considerable time lapse since then, and in light of current concerns – including possible subscriber tying, limited market dynamics, and the absence of recent data – the Agency has concluded that a renewed assessment is both justified and necessary.
The survey will involve the collection of information from a broad range of stakeholders, including providers of media advertising space as well as both direct and indirect advertisers. The Agency stressed that the investigation is not targeted at any specific market participant. Its primary objective is to gain a comprehensive understanding of the functioning of the television advertising market in Slovenia.
Nevertheless, should the inquiry reveal circumstances suggesting potential infringements of ZPOmK-2 or of the Treaty on the Functioning of the European Union (TFEU), the Agency has confirmed that it will take appropriate enforcement action within its powers.
The Agency has also invited all interested parties, including companies and individuals who hold relevant information or data, to contribute to the inquiry by submitting material to gp.avk@gov.si. Once the investigation is concluded, the Agency will publish a full report on its website.
