Turkish Competition Board Opens Investigation into May-Agro Tohumculuk

The Turkish Competition Board has launched a formal investigation into May-Agro Tohumculuk San. ve Tic. AŞ (May-Agro Tohumculuk or MAY TOHUM) following a preliminary inquiry into alleged anticompetitive conduct.

The investigation concerns potential infringements of Article 4 of Law No. 4054 on the Protection of Competition, which prohibits agreements and practices that restrict competition. The Board is examining whether MAY TOHUM engaged in practices aimed at limiting competition by imposing restrictions on the territories or customer groups of its buyers and by determining resale prices.

The decision to initiate a full investigation was taken after the Board reviewed the information, documents, and findings gathered during the preliminary inquiry. At its meeting on 31 December 2025, the Board concluded that the evidence obtained was sufficiently serious to warrant further examination. The investigation was formally opened under Decision No. 25-50/1235-M.

The Board’s inquiry will assess whether MAY TOHUM’s commercial practices constitute a violation of Article 4 through mechanisms such as resale price maintenance and territorial or customer restrictions imposed on downstream buyers.

MAY TOHUM is active in the production and sale of agricultural seeds, with a product portfolio that includes sunflower, corn, cotton, sweet corn, beans, processing tomatoes, and spinach seeds.

The opening of an investigation does not prejudge the outcome of the case. The Board will conduct a detailed assessment to determine whether the company’s conduct infringes competition law and, if so, whether enforcement measures or sanctions are warranted.
