Spain Probes Avanterra Tech for Alleged Agricultural Cartel

The Spanish National Markets and Competition Commission (CNMC) has launched a formal investigation into Avanterra Tech S.L. regarding potential antitrust violations in the agricultural machinery sector. The inquiry focuses on the conduct of Quiles Maquinaria Agrícola and Agronímer during the period before they merged to form Avanterra. While operating as rivals, the two firms allegedly engaged in market sharing by dividing customers into specific zones of responsibility and coordinated their market strategy through the exchange of sensitive information or direct price-fixing.

This regulatory action follows a complaint submitted by the Young Farmers’ Agrarian Association (ASAJA), which prompted the CNMC to carry out targeted inspections at Avanterra’s headquarters in June 2024. These raids were intended to secure evidence of agreements that restrict competition and harm the broader agricultural economy. Under Spanish law, such cartel-like behavior is considered a grave infraction because it artificially inflates prices and reduces the options available to consumers and professionals in the field.

The CNMC emphasizes that the fight against cartels remains a top priority due to the significant economic damage they cause. The commission also utilizes a Leniency Program, which offers immunity or reduced fines to companies that come forward with evidence of illegal agreements. Participants in this program may also avoid the standard prohibition against bidding on public contracts.

The opening of this disciplinary file is a procedural step and does not guarantee a final ruling of misconduct. The CNMC now has a 24-month window to conduct a thorough analysis of the evidence and hear the company’s defense before reaching a final decision. If the allegations are substantiated, the investigation could result in substantial financial penalties for the firm. For the time being, the case serves as a warning of the regulator’s commitment to maintaining fair competition within the Spanish agricultural machinery market.
