Romania Fines Firms €1.66m for Bid Rigging in Road Tenders

The Romanian Competition Council has imposed fines totaling €1.66 million on Oyl Company Holding AG SRL, Autoprima Serv SRL and Saga Infrastructură SRL for colluding in public procurement procedures for road maintenance works organised by the National Company for Road Infrastructure Administration (CNAIR).

According to the authority, the three companies coordinated their commercial strategies in tenders covering routine and periodic maintenance of national roads and motorways in several counties, including Constanța, Tulcea, Brăila, Călărași and Ialomița. The conduct involved allocating contracts among themselves and structuring bids so that preselected companies would win with higher-priced offers, thereby eliminating genuine competition.

The Competition Council fined Oyl Company Holding AG SRL approximately €1.18 million (5.91 million lei), Autoprima Serv SRL around €0.40 million (2.02 million lei), and Saga Infrastructură SRL about €0.07 million (0.36 million lei). All three companies fully admitted their participation in the infringement and benefited from reductions in the level of fines imposed.

The investigation was closed with respect to Asfalt Dobrogea SRL, as the authority did not find sufficient evidence to establish a breach of competition law.

The decision is immediately enforceable, with the fines to be collected by the tax authorities as revenue for the state budget.
