The Spanish National Commission on Markets and Competition (CNMC) has launched a public consultation to update its “Guide to Compliance Programs in Relation to Competition Law,” originally published in 2020. The guide serves as a key reference for evaluating corporate compliance programs and promoting adherence to competition rules.
The review aims to incorporate legislative changes and the practical insights gained over the past five years, ensuring the guide reflects the current economic and business environment. Compliance programs are widely recognized as an effective tool for preventing infringements of competition law, and the CNMC’s guidance has become a standard reference for companies and legal practitioners assessing the design and effectiveness of these programs.
The public consultation is open to all interested parties, including companies, trade associations, legal advisors, consultants, and other stakeholders involved in compliance. Contributions can be submitted through the CNMC’s consultation platform, with the consultation period remaining open until 20 January 2026.
By updating the guide, the CNMC aims to reinforce the role of compliance programs in fostering a culture of competition law observance and to provide clear guidance on best practices and incentives for companies to implement robust compliance measures.
