The Spanish National Commission for Markets and Competition (CNMC) has launched an investigation into potential anticompetitive practices in the private healthcare services market and the health consultancy sector.
The inquiry focuses on whether companies operating in these areas may have engaged in agreements or concerted practices contrary to competition law, as well as whether certain private healthcare providers may have abused a dominant position. If confirmed, such conduct could constitute violations of Articles 1.1 and 2 of the Spanish Competition Act (Ley de Defensa de la Competencia, LDC).
Between 18 and 21 November 2025, the CNMC carried out inspections at the premises of several companies, with the cooperation of a regional competition authority in one of the territories where the investigated companies are located.
These inspections represent a preliminary step that may lead to the opening of formal sanctioning proceedings. The CNMC stresses that the inspections do not prejudge the outcome of the investigation or the liability of the companies involved.
Serious Violations
Agreements between competitors are considered very serious infringements under the LDC and may result in fines of up to 10% of the total turnover of the infringing companies in the financial year preceding the imposition of the penalty.
