The Comisión Nacional de los Mercados y la Competencia (CNMC) has imposed a fine totaling €1.2 million on Endesa Energía and Naturgy Iberia for failing to include mandatory information on their customer bills.
The fine was reduced to €840,000, following voluntary payment by both companies, with €480,000 imposed on Endesa and €360,000 on Naturgy. This penalty stems from their omission of crucial consumer information, as required by law.
Under Spanish electricity sector regulations, energy companies are obligated to include a minimum set of data in customer invoices, including a QR code or link to the CNMC’s price comparison tool for gas and electricity. This tool allows customers to view their consumption data and compare prices with offers from other providers, helping consumers make more informed decisions. Additionally, it provides access to the “Entiende tu factura” service, which explains the charges on their bills.
The CNMC’s investigation revealed that Endesa incorrectly included QR codes, while Naturgy failed to include the link to the comparison tool on certain invoices. These failures were classified as minor infractions under Article 66.5 of the Electric Sector Law, triggering fines at the highest level for such offenses due to the prolonged impact on consumers.
The CNMC has made it clear that the sanctions reflect the significance of these violations, which affected consumers over an extended period. Although both companies have been penalized, the fines were reduced due to their cooperation and timely payment.
The companies have two months to file an administrative appeal against the decision with the Spanish National Court.
