Australia Probes Fuel Giants Over Diesel Supply Concerns

Australia’s competition regulator has taken the unusual step of publicly confirming an enforcement investigation into several of the country’s largest fuel suppliers, signalling mounting concern over the functioning of diesel markets during a period of global instability.

The probe targets Ampol Ltd, BP Australia Pty Ltd, Mobil Oil Australia Pty Ltd and Viva Energy Australia Pty Ltd, following reports that independent wholesalers and distributors—particularly those serving regional and rural areas—may be facing constraints in accessing diesel supply.

The investigation, led by the Australian Competition and Consumer Commission, comes at a sensitive moment for energy markets. Ongoing geopolitical tensions linked to the Middle Eastern conflict have heightened concerns about both fuel availability and pricing, placing additional pressure on supply chains that are already vulnerable to disruption.

By publicly disclosing the investigation at such an early stage, the regulator is departing from its usual practice. The move reflects the scale of concern among businesses, farmers and consumers, for whom diesel remains a critical input cost. It also serves as a clear signal to market participants that conduct in fuel markets is under intensified scrutiny.

At this stage, the regulator has not reached any conclusions about whether competition laws have been breached. However, the focus on access to supply for independent distributors suggests the investigation may examine whether larger suppliers have engaged in practices that could limit competition downstream, particularly in regional markets where alternatives are limited.

The case also highlights a broader regulatory challenge: ensuring competitive market outcomes during periods of external shock. While supply disruptions linked to global events can legitimately affect availability and pricing, competition authorities remain alert to the risk that such conditions may also create opportunities for anti-competitive behaviour.
